1. Acceptance of Terms
By accessing or using Motaware Mail (the "Service"), provided by Motaware LLC ("Motaware"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We reserve the right to update these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.
2. Description of Service
Motaware Mail provides email hosting, webmail access, calendar, contacts, and related communication services as part of Motaware plans. The Service is available through web browsers. Features and availability vary by plan, and the Motaware terms at motaware.com also apply.
3. Account Registration
You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access or use of your account.
4. Acceptable Use
You agree not to use the Service to send spam, distribute malware, engage in phishing, transmit illegal content, harass others, or violate any applicable laws or regulations. We reserve the right to suspend or terminate accounts that violate this policy without prior notice.
5. Privacy
Your use of the Service is also governed by our Privacy Policy. We do not sell your personal data, do not scan email content for advertising purposes, and only collect data necessary to provide and improve the Service.
6. Intellectual Property
The Service and its original content, features, and functionality are owned by Motaware and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of all content you create, send, or store using the Service.
7. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform scheduled maintenance with advance notice. We are not liable for any downtime, data loss, or service interruptions beyond our reasonable control.
8. Payment and Billing
Paid plans are billed on a monthly or annual basis as selected at the time of purchase. Fees are non-refundable except as required by applicable law. We reserve the right to change pricing with 30 days advance notice. Free plans may have usage limitations.
9. Termination
You may cancel your account at any time from your account settings. Upon cancellation, your data will be retained for 30 days before permanent deletion. We may terminate or suspend your account for violations of these Terms.
10. Limitation of Liability
To the fullest extent permitted by law, Motaware shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability shall not exceed the amount you have paid us in the 12 months preceding the claim.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Motaware operates, without regard to conflict of law principles.
